abuse allegations

German term for abuse allegations — claims, not established legal facts

Definition

Abuse allegations (German: Missbrauchsvorwürfe) are accusations or claims that someone has committed abuse, typically sexual abuse, and the term belongs to German law and German journalistic usage. The concept is not in itself a criminal-law category or a statutory term, but a descriptive formulation covering assertions that a person has committed assault. In the contexts where it appears, such as the case concerning Till Lindemann, Missbrauchsvorwürfe is the way the press and the public refer to allegations that are still unconfirmed or undecided. It therefore marks an important distinction: these are claims, not established legal facts.

The actual criminal-law regulation of the conduct such allegations typically concern is found elsewhere in the German Criminal Code (Strafgesetzbuch, StGB). Relevant provisions include § 177 on sexual assault and rape and § 176 on sexual abuse of children. The word Missbrauchsvorwürfe thus points toward these provisions without being identical to them.

Because the term describes allegations rather than convictions, it is central in German media coverage and court proceedings to distinguish between Vorwürfe (allegations) and an actual criminal-law decision. A person who is the subject of Missbrauchsvorwürfe is not legally guilty unless a court has so determined.
