infiltration
Covert penetration of criminal or hostile networks — unregulated in Danish law
Definition
Infiltration is the method whereby a person — typically a police officer, intelligence agent or informant — covertly penetrates a criminal milieu, an extremist organisation or a hostile network without revealing their actual role or identity. The purpose is to gather information about the organisation's structure, plans or members from the inside, in a way that would not be possible through conventional investigative methods.
In practice, infiltration can take two forms: either a trained agent assumes a false identity and operates undercover over time, or an already existing insider — an informant — is recruited to pass information to the authorities. Both forms are represented in the classic cases: the FBI informant Joe Moore infiltrated the KKK and exposed a murder plot from within, while the Danish espionage case concerning North Korea's European network illustrates state intelligence infiltration across borders.
Under Danish law, infiltration is not regulated by a separate statutory provision. The method is legally distinguished from agent activity (agentvirksomhed), which is the concept the Danish Administration of Justice Act (retsplejeloven) expressly addresses. This legal grey zone means that infiltration operations in Denmark rest on an unregulated basis, which is in itself a source of legal-policy debate about oversight, accountability and due process. The absence of statutory regulation distinguishes Danish practice from, for example, British law, where the Regulation of Investigatory Powers Act and subsequent legislation have attempted to set a framework for undercover operations — albeit with mixed results, as the British police scandal concerning undercover officers in activist circles shows.
As a method, infiltration raises fundamental questions of proportionality, human rights and rule-of-law principles: how far may an undercover agent go in order to maintain cover? At what point does state intervention become a violation of privacy or a form of state entrapment? These questions are central in a true crime context, because they expose the tension between effective crime control and the legal limits on the exercise of state power.
