police failure

Descriptive term for police omissions in investigating and handling criminal cases

Definition

Police failure refers to situations in which the police have omitted to do what is normally expected in a criminal case — including investigating, questioning witnesses, securing evidence, or properly following up on reports and inquiries. Under Danish law the term is not defined in any specific statutory provision, but functions as a descriptive label for systemic or concrete errors in police case handling.

In true crime journalism and documentaries, the term typically appears in connection with cases where serious crimes either went unsolved, were solved too late, or where innocent people were affected by deficient investigation. Common to such cases is that the actions of the police — or the lack of them — have had direct consequences for victims, relatives, suspects or for legal certainty more broadly.

Examples of conduct described as police failure include failure to follow up on reports, misallocation of resources, inadequate preservation of evidence, and instances where the police have overlooked patterns in repeated offences. In cases such as those examined in 'In the Dark' and 'The Grindr Killer Scandal', it is documented how such lapses can contribute to perpetrators remaining at large for extended periods.

Police failure may in certain cases have legal consequences. Serious lapses can raise questions of disciplinary liability for public officials or of liability in damages on the part of the state, just as errors in the investigation can lead to evidentiary problems at trial and, ultimately, to acquittal. It is, however, the journalistic and popular use of the term — rather than the legal one — that predominates in the true crime genre.

The use of the term reflects a wider public debate about police resources, priorities and internal culture. True crime media have increasingly helped bring visibility to cases where authorities did not act sufficiently, thereby placing police failure on the public agenda across jurisdictions.
