Police corruption
Abuse of police position for improper gain, prosecuted under §§ 122 and 144
Police corruption denotes situations in which a police officer or police authority abuses their public position to obtain improper advantages or to act in breach of official duties. The concept is broad and covers everything from outright bribery to more concealed forms of abuse of power, including the deliberate withholding of evidence, the fabrication of incriminating material against innocent people, and systematic cooperation with criminal networks.
Under Danish law, "corruption" does not exist as a single, self-standing criminal concept in the Penal Code. The acts described in everyday speech and in crime journalism as police corruption are instead prosecuted under specific provisions on offences in public office and bribery. The Danish Penal Code (straffeloven) § 144 criminalises a person in public service who improperly receives or allows themselves to be promised a gift or other advantage. Section 122 criminalises active bribery — that is, granting, promising or offering an advantage in order to make a public servant act or refrain from acting in their service.
In serious cases, police corruption can lead to wrongful convictions, since manipulated investigations and falsified evidence may be decisive for the outcome of a criminal case. Cases such as the Eirik Jensen case in Norway and the Sean Ellis case in the United States illustrate how systematic corruption within the police can keep innocent people behind bars for years and undermine public confidence in the justice system.
Police corruption differs from individual errors of judgement by its character of deliberate and often repeated abuse of public authority. In the most serious instances it amounts to structural or institutionalised corruption, where numerous officers or entire units act in concert with criminal circles over an extended period — as documented, for example, in the Thabo Bester escape case in South Africa, where prison staff helped stage a fake death.
