Manslaughter under § 237 of the Danish Penal Code where the parties are married

Spousal homicide is not an independent legal category in Danish criminal law, but a term for manslaughter under the Danish Penal Code (straffeloven) § 237 where the perpetrator and the victim are married to each other. The general homicide provision thus applies regardless of the relationship between the parties. Section 237 reads: "Any person who kills another shall be punished for manslaughter by imprisonment from 5 years to life." The provision sets out no separate requirements as to the relationship between perpetrator and victim — spousal status does not affect the elements of the offence.

In practice, the term also covers situations described internationally as intimate partner homicide or uxoricide. Such cases typically raise questions about prior violence in the relationship, motive and planning, all of which are relevant to the specific sentencing decision. The broad sentencing range — from 5 years to life — allows the courts to take account of the overall circumstances of the case, including whether the killing was premeditated, whether there was particular cruelty, or whether the perpetrator acted under mitigating circumstances.
