assault

Unlawful physical attack on another person, covered by straffeloven §§ 244–246.

Definition

Assault (Danish: overfald) denotes, in both everyday and legal usage, an unlawful physical attack directed at another person's body, and under Danish criminal law such acts are governed primarily by the violence provisions of the Penal Code. The word itself does not appear as an independent legal definition in the Danish Penal Code (straffeloven), but is used as a descriptive linguistic label for the sudden and forceful attack that the provisions are intended to cover.

The central provision is straffeloven § 244 on simple violence: a person who commits violence against or otherwise attacks the body of another may be punished by a fine or imprisonment for up to 3 years. This is the provision most often applied in practice to what is colloquially called an assault. More serious cases of physical attack may fall under § 245, which covers violence of a particularly crude, brutal or dangerous character, and § 246, under which the penalty may rise to 10 years' imprisonment if the violence has been of such a severe nature, or has caused such serious injury or death, that particularly aggravating circumstances are present.

Which provision applies depends on a concrete assessment of the nature of the attack, the means used, the extent of the injury and the overall circumstances. It is therefore not the label "assault" in itself, but the actual course of events, that determines the legal classification.
