knife attack

A knife attack is a violent act in which the perpetrator uses a knife or another cutting or stabbing weapon against another person. The term is descriptive and typically appears in media coverage, police reports and court cases as a description of the course of events — not as a separate legal offence category. Under Danish criminal law, a knife attack is assessed under the general provisions depending on the seriousness and outcome of the incident. If the attack results in a person's death, the case may be brought as homicide under the Danish Penal Code (straffeloven) § 237. If the injured party survives, the charge may instead concern attempted homicide or one of the Penal Code's provisions on aggravated violence. It is therefore the concrete circumstances of the case — including intent, the extent of the injuries and the perpetrator's actions — that determine which provision applies.

In the incidents the term is typically associated with in a true crime context — including attacks in public squares and urban spaces — there are often mass incidents with several victims, where the prosecution may bring charges for one or more offences at the same time. Homicide cases are heard at first instance in the district court as jury cases and may be appealed to the high court.

In addition to the criminal consequences of the attack itself, possessing or carrying a knife in a publicly accessible place may in itself constitute an offence. The Danish knife law (knivloven) generally prohibits carrying or possessing knives and bladed weapons in places accessible to the general public unless a recognised legitimate purpose exists. A violation of this can be punished separately, regardless of whether the knife was used in an attack.
