psychological manipulation

Descriptive term, not a legal category; overlaps with § 243 on psychological violence

Definition

Psychological manipulation denotes the deliberate and systematic influencing of another person's thoughts, judgements or freedom of action with the aim of making that person perceive, believe or act in a particular way — typically to the manipulator's advantage and at the victim's expense. Under Danish law, the concept is not a fixed legal category but a descriptive term covering a broad range of behavioural patterns: deception, gaslighting, targeted disinformation and psychological control.

In criminological and legal contexts, psychological manipulation overlaps to a large degree with the concept of psychological violence, which is regulated in the Danish Penal Code (straffeloven) § 243. This provision criminalises repeated, grossly degrading, harassing or offensive conduct that is capable of improperly controlling a person. It is precisely this element — the deliberate control of another human being — that links psychological manipulation to punishable conduct in Danish law.

In a true crime context, including cases such as the Pam Hupp case, the term is used about a perpetrator's tactical and calculated influencing of those around them: controlling the victim's perception of reality, manipulating witnesses or investigators, and constructing false narratives in order to avoid suspicion or shift blame onto others. In this sense, manipulation functions as a central criminal tool rather than an isolated episode.

The legal assessment of psychological manipulation in specific cases depends on the particular acts and their consequences. Where there is persistent conduct directed at a close family member for the purpose of control, § 243 on psychological violence will typically be the relevant provision. Where manipulation forms part of a fraud or the preparation of a violent crime, other provisions come into play. Because psychological manipulation is not an independent criminal law category in Denmark, the legal qualification always rests on a concrete assessment of which acts have been committed and which statutory provisions they fall under.
