public safety
A political and descriptive Danish concept rather than a fixed criminal-law category
Definition
Public safety denotes, in a Danish context, the concern for maintaining basic societal functions and protecting the population against serious threats, including violent crime and homicide. The concept is not defined as a fixed criminal-law category in Danish legislation, but functions as an overarching security designation covering the responsibility of the state and the authorities for ensuring public order and security.
In connection with serious crime — such as knife attacks with fatal outcomes or serial killings — public safety is typically used to describe the consideration that justifies particularly far-reaching legal and political responses. It concerns the collective interest of the population in being protected against violence and in being able to move safely in public spaces.
In practice, the concept overlaps with the more precise legal expression public security and safety, known from criminal procedure and police legislation. Here, the consideration of public safety enters into, for example, the assessment of pre-trial detention, measures imposed in lieu of punishment, and other custodial measures directed at dangerous offenders.
In media and criminal-policy usage, public safety is furthermore used to frame discussions of whether the criminal justice system responds adequately to extraordinarily dangerous perpetrators — including questions of preventive detention, expulsion, or harsher penalties. It is thus primarily a political and descriptive concept rather than a technical legal one.
