Finanstilsynet

The Danish authority supervising banks and securities markets — not a court.

Finanstilsynet is the Danish state authority that supervises the financial sector and the securities market. It is organisationally placed under the Danish Ministry of Industry, Business and Financial Affairs (Erhvervsministeriet), and its task is to ensure that banks, mortgage credit institutions, insurance companies, pension companies, investment firms and other financial actors comply with applicable legislation and treat customers honestly and loyally.

Finanstilsynet is an administrative authority, not a court. This means it can issue orders, demand information, carry out inspections and, in serious cases, withdraw licences — but the actual prosecution of financial crime takes place in cooperation with the prosecution service and the police, in particular the State Prosecutor for Special Crime (Statsadvokaten for Særlig Kriminalitet).

In a true crime context, Finanstilsynet is relevant as the type of institution expected to detect, prevent and intervene against financial crime: fraud, deception, unlawful speculation, money laundering and systematic abuse of financial structures. When such authorities fail or react too late, this can contribute to the large collapses that characterise classic financial scandal cases. Cases such as the S&L crisis in the United States and the collapse of FTX under Sam Bankman-Fried illustrate what can happen when supervisory authorities lack either the powers, the resources or the political will to intervene in time.

In that sense, Finanstilsynet — and corresponding authorities in other countries — functions as a central element of the institutional framework that either prevents or fails to prevent large-scale financial crime. Its work is therefore not merely a question of regulatory compliance in a narrow sense, but forms a significant part of society's defence against the kind of systematic fraud and market abuse documented by the true crime genre in cases from around the world.
